In conjunction
with the affected communities at Clark and Subic and San Francisco nonprofit
Arc Ecology, FACES is participating in a lawsuit to require the US military
to conduct environmental assessments at the former bases under US environmental
law.
BACKGROUND
Under a provision of US Superfund law that deals with the cleanup of hazardous
waste contamination, any person affected by the release of contamination
from US installations may petition the US government to conduct a so-called
“Preliminary Assessment/Site Inspection” (PA/SI) of a contaminated site.
This PA/SI would identify the toxic “hot spots” at Clark and Subic and
determine the extent of contamination. This would allow affected communities
and groups to implement measures to protect public health and the environment.
A PA/SI is also the first necessary step before conducting a systematic
cleanup of toxic sites.
US
REJECTION
Residents around Clark and Subic submitted petitions to the US Air Force
and US Navy in 2000 but the US military rejected them.

CAMPAIGN
Members of the affected communities, supported by FACES and San Francisco
based Arc Ecology are now taking legal action against the US Air Force
and US Navy to enforce the law. The lawsuit will be filed in early December
at the San Jose Federal District Court, with an expected response from
the US government by early February 2003.
